Patreon Downloads

The artist/label signs an agreements with Indie Folk Central that allows Indie Folk Central to share the artist’s music as a free download on Patreon. The downloader can only use the downloaded file for listening purposes and is not allowed to re-share it. Please read the full terms of this download:

License terms

1.- The Licensor grants the Licensee a non-exclusive and non-transferable license for online download of the musical works of his repertoire through the portal www.patreon.com/indiefolkcentral may be made by visiting users of said portal within the period of availability of the musical works that are specified in the following clause.

2.- The musical works referred to in this license are those listed and identified in the ‘Authorization’ agreement between The Licensor and The Licensee.

3.- This license is free as far as the Licensee is concerned, not having to pay any right to The Licensor, who expressly accepts it, by virtue of the musical promotion activity that the Licensee exercises through Indie Folk Central’s YouTube, Spotify, SoundCloud and social media pages. Likewise The Licensor acknowledges and accepts that the Licensee will receive economic contributions from the users who are part of its portal www.patreon.com/indiefolkcentral, under the concept of support for said portal. Said contributions shall strictly belong to the Licensee, and The Licensor expressly declares that he has no rights over said contributions.

4.- The license conferred here is global in scope, and covers all the territories of America, Europe, Asia, Africa and Oceania.

5.- The availability in the portal www.patreon.com/indiefolkcentral for online download of the musical works object of this license, will be for a maximum of thirty (30) continuous days.

6.- This license is conferred only for personal use of the licensee under the terms of this instrument.

7.- Exclusions: The license hereby expressly excludes the use of the repertoire of the Licensors in the following activities: a) The resale and / or sub-licensing of all or part of the repertoire hereby licensed by the Licensee User; b) Make use of the repertoire here licensed in any medium that promotes violence or incitement, obscenity, racism or hatred towards any group, or in films that encourage discrimination against a person or a group of people for reasons of race , religion, gender, sexual orientation or national origin; c) use of the repertoire here licensed in any way that constitutes a threat, damage, invasion of privacy, defamation or any other use or offensive content.

8.- Related Rights: The Licensee User recognizes that the musical works that are part of the repertoire here licensed come from sound recordings of artistic performances (phonograms) whose use generates an economic right in favor of the artists, performers and phonographic producers who they have made such sound fixations, which is different from the right that corresponds to authors and composers for the use of their works. Said economic right is included in this license, under the powers of the Licensors.

9.- Exclusion of Guarantees and Liability: The Licensor is not responsible in any case for any damages of any kind that could cause errors or omissions in the contents, lack of availability of the portal or the transmission of viruses or malicious programs or harmful to the contents, despite having adopted all the necessary technological measures necessary to avoid it.

10.- Surveillance: The Licensor will have the broadest faculties of verification and inspection on the use of the repertoire licensed here done by the Licensee User, and will adopt the measures that they consider pertinent to preserve the integrity of this license and its repertoire.

12.- Legal Actions: The Licensor will pursue the breach of these conditions as well as any misuse of the repertoire here licensed exercising all civil and criminal actions that may correspond by law.

13.- The different use by the Licensee of the repertoire in modalities and forms different from those conferred in this instrument, causes the immediate revocation of this license. In case of revocation, the use of the musical repertoire of The Licensor by The Licensee is expressly prohibited.

14.- The duration of this license will be thirty (30) days from the date on which the Licensee places the repertory musical works licensed here on its portal. The Licensee must notify The Licensor about the exact date of availability of the repertoire musical works licensed here in its portal for all relevant purposes.

 

15.- Jurisdiction: For the purposes of the conditions established in this license the applicable legislation will be the regulations and laws of The Netherlands and all international treaties about Copyrights that are also applicable, and any controversy will be submitted to the Courts of the city of Apeldoorn in The Netherlands.
